DATA PROTECTION CHARTER

PREAMBLE

The AEROGROUPE SAS Group (hereinafter “AEROGROUPE SAS”), with a share capital of 53,820, comprising the company AEROPHILE SAS, as well as all of its subsidiaries within the meaning the provisions of Article L 233-1 of the French Commercial Code, existing and future, is the publisher of content, products and services available on various print and digital media digital media, including applications, newsletters, websites, social platforms and any other existing media (hereinafter “the Services”).

AEROGROUPE SAS attaches great importance to the protection of the Personal Data of its customers, users of its websites and mobile applications, its partners and its employees.

This charter (hereinafter “the Charter”) presents the commitments of AEROGROUPE SAS for the protection of the Personal Data of Internet users visiting this site or this application (hereinafter referred to as “the Site”) and users of the Services.

It also informs you of the procedures for collecting and using your Personal Data and the options you have in this regard.

It may be modified at any time by AEROGROUPE SAS, in accordance with the modifications made, in order to comply with any regulatory, jurisprudential, editorial or other changes, jurisprudence, editorial and/or technical.

You are advised to refer to the latest version of the Charter accessible on our Services.

AEROGROUPE SAS complies with the General Data Protection Regulation, no.2016/679 of 27 April 2016, the law “Informatique & Libertés” No. 78-17 of 6 January 1978 modified, as well as the law “for the confidence in the digital economy” n° 2004-575 of 21 June 2004 (article L. 34-5 of the French Post and Electronic Communications Code).

AEROGROUPE SAS has set up an e-mail address dedicated to: the right to information, the right of access, rectification, opposition, deletion, limitation and portability of which you have in accordance with the aforementioned law (mail: dpo@aerophile.com).

The Charter applies in addition to the provisions of the General Conditions of Use of the Services and the General Conditions of Sale of the Services, when they exist.

 

ARTICLE 1: WHAT IS THE IDENTITY OF THE DATA CONTROLLER?

The person in charge of processing is the company AEROGROUPE SAS, SAS with a capital of 160 000 €, registered with the RCS of PARIS under N°390 395 671, and identified fiscally under the N°FR04 390 395 671, whose registered office is located at 17 rue Vasco de Gama 75015 PARIS.

 

ARTICLE 2 – WHY IS YOUR PERSONAL DATA COLLECTED BY AEROGROUPE SAS COLLECTED BY AEROGROUPE SAS?

AEROGROUPE SAS may be required to collect and process declarative data, behavioral data of

ARTICLE 3 – WHAT PERSONAL DATA IS COLLECTED BY AEROGROUPE SAS?

3.1. Declarative data: AEROGROUPE SAS is likely to constitute one or more files containing information that you voluntarily provide to it in order to benefit from a Service. This Personal Data is collected when you place an order (ticketing), or during any other marketing activities (e.g., games, studies, surveys, etc.) and regardless of the Service used.

This data is :

– those necessary to contact you:

o your identity (title, surname, first names, date of birth, pseudo);

o your contact data (postal and/or e-mail address, telephone number);

– those necessary for the execution of the services we provide you:

o navigation and connection data: IP address, connection data and navigation data;

o Transaction data such as transaction number, purchase details, good or service purchased;

o data relating to the organization and processing of contests, lotteries and any promotional operation such as the date of participation, the answers to the contests and the nature of the prizes offered;

o data relating to the contributions of persons who opinions on products, services or content, including their pseudonym;

o photographs in the context of blogs in which you participate;

– those useful for getting to know you better:

o your data relating to the follow-up of the commercial relationship: requests for documentation, purchased product, subscribed service, quantity, amount, frequency, delivery address, history of purchases and services, correspondence with the customer and after-sales service, exchanges and comments from customers and prospects, person(s) in charge of the customer relationship;

When your data is used for direct prospecting by e-mail or SMS, your prior consent is required.

It may be proposed to you to receive commercial offers :

– from the AEROGROUPE SAS group

– from its subsidiaries: AEROPHILE, AEROPARIS, AEROTOURISM, OPERAPRINCE, AEROPRINCE, AEROPHILE ORLANDO, AEROPHILE CALIFORNIA, AEROMOBILE.

As an exception, and in accordance with applicable regulations, in the event that these data were collected in the context of the sale of one of our products or a service and that they are used for the sending of prospecting intended to promote similar products or services provided by AEROGROUPE SAS, your contact information could be used without your consent. Similarly, your consent will not be required for prospecting by telephone or mail. In these two assumptions, AEROGROUPE SAS processes your data for the purposes of interests considered legitimate by the regulations, without this having any consequences for your rights.

When collecting Personal Data, the forms for creating an account, ordering online or providing online order or information forms specify the data that must be provided to be communicated to benefit from the Service concerned, the optional data and the consequences of optional data and the consequences of not providing a data.

Interaction data: in addition, AEROGROUPE SAS may be required to process interaction data between you and our company: opening or linking to newsletters that we send, clicks on the links in the newsletters that we send. These information allows us to adapt the exchanges that we maintain with you.

 

ARTICLE 4 – WHO ARE THE RECIPIENTS OF THE PERSONAL DATA?

The Personal Data is intended for AEROGROUPE SAS and its subsidiaries. Your declarative data may also be transmitted to service providers by AEROGROUPE SAS to ensure the effectiveness of the Services that you have ordered, for example to order tickets. These service providers are signatories of the standard contractual clauses validated by the European Commission.

In accordance with the regulations in force, the declarative data may be transmitted to the transmitted to the competent authorities upon request.

 

ARTICLE 5 – HOW LONG WILL THE PERSONAL DATA BE KEPT?

Depending on the purpose of the processing, the duration of the storage of the Personal Data is likely to vary.

Except for mandatory legal provisions, AEROGROUPE SAS keeps the Personal Data for the time necessary to achieve the purpose of the processing.

The Personal Data will thus be kept for the period during which you use our services, and deleted no later than three years from our last contact, unless contact, except for anonymization or legal obligation to preserve certain data for a longer. The analytical data of connection to the Site will be kept only for a period of thirteen months.

 

ARTICLE 6 – WHAT IS AEROGROUPE SAS’ POLICY REGARDING COOKIES AND SIMILAR IDENTIFICATION TECHNOLOGIES?

AEROGROUPE SAS uses cookies and similar identification technologies. A cookie is a small data file copied to your computer’s hard drive by a website. It records information relating to your computer’s navigation on a site (such as the pages visited or the dates and times of consultation), which can be read during your subsequent visits to the Site.

AEROGROUPE SAS may send cookies when you visit its Sites or when you register to access an online Service.

Access to certain offers and sections may then be altered or even impossible. You can restrict the use of cookies by changing the setting of your browser:

In Internet Explorer:

Click on Tools at the top of the browser window and select Internet Options > In the options window, click on the Privacy tab > To enable cookies, set the slider to Medium or lower > To disable cookies, move the slider to the top to block all cookies.

In Firefox:

Click on Tools in the browser menu and select Options >  To enable cookies, check the box next to “Accept Site Cookies”. To disable cookies, deselect the Accept Site Cookies checkbox.

In Chrome :

Click the wrench icon in the browser toolbar > Select the Settings option > Click the Settings button > Select the Settings option > Click Show Advanced Settings > In the Privacy section, click the Content Settings button > To enable cookies, select Allow local data storage in the Cookies section.

Both proprietary and third-party cookies are now allowed. To accept only proprietary cookies, select Block all third-party cookies without exception > To disable cookies, select Prohibit all sites from storing data in the Cookies section.

In Safari:

If applicable, open Safari > Choose Safari > Preferences, then click Privacy > In the Block Cookies section, specify whether and when Safari should accept cookies from the Site under what circumstances > For an explanation of each option, click Details > To see which websites store cookies on your computer, click Details.

For other browsers and mobile devices: if you want to restrict the use of cookies for another browser or on a mobile device, go to the official web page of the browser or device manufacturer or consult the documentation they have provided, and then follow the instructions.

AEROGROUPE SAS may use other identification technologies in addition to cookies that fulfill the same role as mentioned above and in mobile environments where cookies do not work. These solutions may be SDKs (Software Development Kit) or Local Storage or any other adapted solution.

 

ARTICLE 7 – WHAT SECURITY MEASURES?

Any user opening an account is invited to create an identifier or pseudo and a password. This password must remain secret and you must limit access to your computer or mobile devices and log out once you have finished using our services.

In addition, AEROGROUPE SAS has implemented technical and organizational measures to protect Personal Data against accidental loss, destruction, deterioration, abuse, damage and unauthorized or illegal access.

Since Personal Data is confidential, AEROGROUPE SAS limits access to it to employees or service providers who need it to carry out the processing, the execution of the treatment.

All persons having access to Personal Data are bound by a duty of confidentiality and may be subject to disciplinary measures and/or other sanctions if they fail to respect these obligations.

When we use subcontractors, service providers or transmit Personal Data to partners, suppliers to partners, this communication is subject to a contract to ensure the protection of this information.

 

ARTICLE 8 – WHAT ARE YOUR RIGHTS AND HOW TO EXERCISE THEM?

You have, subject to the limits provided by the regulations in force, several rights regarding to the processing of your Personal Data:

– the right to be informed about the use of your Personal Data,

– the right to access the personal information we have about your personal information we have about you,

– the right to request the correction of Personal Data that is inaccurate, incomplete, equivocal, outdated (which you can also do directly in the “my account” section when you have created one),

– the right to request that AEROGROUPE SAS delete your Personal Data or that it stop processing them in certain circumstances,

– the right to withdraw your consent to receive information from us and object to the processing of your data,

– the right to define directives concerning the fate of your Personal Data after your death,

– the right to complain to the national authority in charge of protection of Personal Data (in France, this is the Commission Nationale de l’Informatique et des Libertés, the CNIL) to stop receiving messages from AEROGROUPE SAS. When you wish to exercise a right, your requests must be presented in writing and must be signed and accompanied by a photocopy of an identity document bearing your signature. The request must specify the address to which the reply should be sent.

AEROGROUPE SAS will have a period of 1 (one) month to respond following receipt of your request. This period may be extended by two months, taking into account the complexity and the number of requests sent to AEROGROUPE SAS. In this case, we will inform you of this extension and the reasons for it.

 

ARTICLE 9 – WHAT ABOUT THE USE OF MY DATA VIA SOCIAL NETWORKS?

You can join our Instagram, Twitter, Facebook, Youtube and LinkedIn accounts from our website and through them, follow our news. The only data that AEROGROUPE SAS is likely to collect is anonymous and processed for purely statistical purposes (including to monitor the number of subscribers who follow these accounts).

AEROGROUPE SAS is not responsible for the processing that may be done with Personal Data by these social networks. In order to know your rights in relation to these social networks and set the options to protect your privacy, it is advisable to consult the privacy policy of each of them.

Logging in with your Instagram, Facebook, LinkedIn or Twitter account: You have the option to connect to some of our sites or applications with your Instagram, Facebook, LinkedIn or Twitter account.

When you connect to our sites with your Instagram, Facebook, LinkedIn or twitter account, AEROGROUPE SAS may have access to certain information that you have transmitted to these social networks. An authorization to access your profile data and to share your activities with Instagram, Facebook, LinkedIn and Twitter will be requested and you will be informed what data is used and how it will be used and shared. On the other hand, any additional information we may request from you will not be shared with Instagram, Facebook, LinkedIn or Twitter.
